Summary Judgement Granted in Favor of Defendant

Chandler Atkins and Kelly Kirkbride recently obtained summary judgment in a case in which the plaintiff filed suit against a used car dealership following a car accident, claiming the plaintiff was injured due to defects in the used vehicle.  The suit alleged both strict liability and negligence on the part of the dealership.  The defense argued that strict liability does not apply to sellers of used goods sold in an AS IS condition, such as the vehicle at issue.  As to the negligence claims, the defense argued that several acts intervened to cause the plaintiff’s injuries, including criminal acts, breaking the chain of causation. The trial judge granted summary judgment on all claims in favor of the defendant.
