Jason Guerra Obtains Defense Verdict in Civil Litigation Lawsuit

Jason D. Guerra obtains defense verdict on behalf of the owner of a public parking lot in the City of St. Louis.   Plaintiff brought suit against the parking lot owner seeking damages after her vehicle was broken into and several thousand dollars of personal property was stolen. Plaintiff claimed that the parking lot company owed her a duty to protect her vehicle from damage and theft and was negligent in failing to do so. The defense maintained that it owed plaintiff no duty under Missouri law, as Plaintiff parked her own car and kept the keys to the car while it was parked in defendant’s lot, and thus, there was no actual bailment of the vehicle and no duty was owed to plaintiff under the law. On May 28, 2014, a verdict was returned in the City of St. Louis in favor of defendant.
