John Schaberg Obtains Defense Verdict in Premises Liability Trial

1/11/2011

Case – Lisa Thomson vs. Darlene Haslock d/b/a Train Station Restaurant.

Defense’s Attorney – Roberts Perryman P.C. ; John Schaberg, St. Louis MO

Haslock asked Thomson to carry some 2×6 boards down some stairs at the Train Station Restaurant.  While carrying boards with her 13 year old daughter Thomson injured her left hand.  Plaintiff argued the building was dangerous because it was dark and the steps were steep, but did not know what caused her to lose control of the boards causing her injuries.

Plaintiff’s medical bills exceeded $13,000.  Plaintiff claimed permanent disfigurement and disability (unpaired grip).  No loss of income was claimed by Plaintiff.

After a two-day trial the jury was out for 30 minutes, returning with a unanimous verdict in favor of the defense.
